Outline of the Polish legislation in the field of nuclear industry

Problem of Polish legislation in a field of nuclear power industry is that the law is completely unsuitable for nuclear power plant. It does not support operation issues and also investment process. According to [166], construction of nuclear power plant with today law would last 50 years, but there is no certainty that it would be possible at all.

Polish main document, "Prawo atomowe", has been established in different political system, where centrally planned economy has not required any investment process. Today, constructing such expensive facility as nuclear power plant without clear and transparent rules of investment is particularly impossible. The Act establishes general framework for nuclear safety and wastes management, but in fact they are more proper for research reactors than for large commercially operating unit. The scale is totally different. There is no competent regulatory authority that can handle with large nuclear industry.

In the European Union, legislation of nuclear power industry is established by European Atomic Energy Community - competent authority. In Poland there is no such body so far. [167]
