Outline of the Polish legislation in the field of nuclear industry

Act of "Prawo Atomowe"

"Prawo atomowe" [168] is the most important Polish legal act, regulating issues of nuclear power industry. The structure of the Act bases on act from 1986, when the Zarnowiec nuclear power plant was under construction. The current version of the law has been in force for 10 years, since the legislator has been forced to make the EU law implementation in national legislation. In the vast majority, the Act concentrates on workers and public health. Articles includes environmental and property protection and concerns issues of dangerous ionizing radiation, radiological protection nuclear wastes and spent fuel management. Moreover "Prawo atomowe" defines rules of civil liability of damages caused by nuclear power industry. In the field of investment, legal solutions are at the level of year 1986. Polish law does not provide opportunities to support the development of new nuclear technologies. Cooperation in this field is not described as well.

Undoubtedly the main Polish legal act of nuclear power industry required thorough amendment. In the light of existing European Community legislation, new Polish law on nuclear energy must be consistent with the law of the European Union briefly discussed in the Outline of the UE legislation in the field of nuclear industry.
